Tra le più significative innovazioni introdotte nel Codice civile del 1942, quella forse di maggiore spessore sistematico fu il ricorso ad una partizione in sei libri: scelta di fondo, in manifesta rottura con la tradizione che il Codice civile del 1865, imitando il Code Napoléon, aveva fatto propria. L'introduzione tra i nuovi libri di uno dedicato alla categoria concettuale della " Tutela dei diritti" costituì una scelta inedita (normativamente, se non scientificamente); ed originale fu la collocazione nell'alveo d'esso d'istituti apparentemente eterogenei tra loro - o quantomeno tradizionalmente intesi come tali - quali la trascrizione, le prove, le norme di responsabilità patrimoniale, le cause di prelazione e della conservazione della garanzia patrimoniale, le regole inerenti la "tutela giurisdizionale dei diritti" e quelle sulla prescrizione. La "singolarità" di un oggetto, in quanto tratto peculiare di esso (ed a condizione che non abbia mera valenza estetica) è spesso rivelatrice della sua autentica natura. L'autore studia il libro VI nella sua dimensione storica, con particolare riguardo alle peculiarità che ne contraddistinsero la genesi, tanto sul piano della forma, quanto sul piano del contenuto, ed ambisce a fornire un contributo alla comprensione dell'autentica cifra di quel libro: quello che vide la luce alla fine della lunga stagione della codificazione fu solo un libro "residuale" e "di chiusura" o piuttosto costituì l'esito di un percorso scientifico di perfezionamento strutturale e concettuale che rispecchiasse anche il portato ideale sotteso alla nuova codificazione? La risposta è tale da gettare ulteriore luce sull'intera opera legislativa venuta a compimento nel 1942.
