While comparative constitutional law is a well-established field, less attention has been paid so far to the comparative dimension of constitutional history. The present volume, edited by Francesco Biagi, Justin O. Frosini and Jason Mazzone, aims to address this shortcoming by bringing focus to comparative constitutional history, which holds considerable promise for engaging and innovative work along several key avenues of inquiry. The essays contained in this volume focus on the origins and design of constitutional governments and the sources that have impacted the ways in which constitutional systems began and developed, the evolution of the principle of separation of powers among branches of government, as well as the origins, role and function of constitutional and supreme courts.

Un peu plus d'un quart de siècle après sa création, l'organisation pour l'harmonisation du droit des affaires en Afrique (OHADA) poursuit sa construction. Des professionnels du droit ont répondu à la question de savoir si l'OHADA est en marche. Cet ouvrage rassemble les contributions pratiques ou de fond sur les thèmes suivants : regards croisés entre la cour commune de justice et d'arbitrage de l'OHADA et les juridictions suprêmes nationales, la cassation ici et ailleurs, la profession de mandataire dans l'acte uniforme portant procédures collectives d'apurement du passif, les pratiques de l'arbitrage CCJA ainsi que la médiation dans l'espace OHADA.

This book explores the history of the international order in the eighteenth and nineteenth century through a new study of Emer de Vattel’s Droit des gens (1758). Drawing on unpublished sources from European archives and libraries, the book offers an in-depth account of the reception of Vattel’s chief work. Vattel’s focus on the myth of good government became a strong argument for republicanism, the survival of small states, drafting constitutions and reform projects and fighting everyday battles for freedom in different geographical, linguistic and social contexts. The book complicates the picture of Vattel’s enduring success and usefulness, showing too how the work was published and translated to criticize and denounce the dangerousness of these ideas. In doing so, it opens up new avenues of research beyond histories of international law, political and economic thought.
