XIe International urban law Congress

The protection of the architectural and natural heritage and its relationship with urban planning


Introduction

The protection of heritage, whether of a real estate or immaterial nature, is one of the values that society as a whole must have as a guiding principle, requiring corresponding public policies to integrate the necessary protection of relevant buildings and groups of buildings in urban environments from the perspective of sustainable urban planning in its environmental, economic and social aspects.

To this end, urban planning has always been concerned with establishing, in its planning instruments, management or discipline regimes, a set of specialties and connections with the protection of cultural heritage. This relationship occurs at all levels, both internationally –from the so-called Athens Charter– and the internal dimension. Thus, both the state legislation –with Law 16/1985, June 25, of the Spanish Historical Heritage (successor to the Law of May 13, 1933)–, as well as the autonomous legislation –for example, Law 9/1993, September 30, of the Catalan Cultural Heritage– and also the local, essentially municipal administration, have been in charge of feeding this symbiotic relationship. In this sense, we must emphasize the importance of not only the declarations of all categories of objects of cultural interest and the cataloguing of protected elements of the different planning figures, but also the special plans for protection of historical sites, aesthetic conditions and admissible uses that enable the preservation of the architectural achievements of the past with an adequate integration of progress.

This congress intends to address the instruments and techniques of heritage protection and its formulas in Spain and other countries, in order to obtain an adequate comparative vision. In this sense, the determinations derived from the UNIESCO Convention Concerning the Protection of the World Cultural and Natural Heritage (1972) in its monumental and planning aspects will be discussed; and, in accordance with the national protection techniques and the category of goods of cultural interest and their planning implications, it will analyze the specific aspects of territorial and local planning that preserve the cultural heritage and the cultural heritage of each municipality.
