Legal semiotics emphasizes the contingency and fluidity of legal concepts and stresses the existence of overlapping, competing and coexisting legal discourses. In response to new problems, changing power structures, changing societal norms and new faces of injustice established doctrines are reconsidered, reformulated and partly replaced by competing doctrines and hypotheses. Given the relative indeterminacy of law, it is no surprise that the problem of interpretation has always been one of the focal points of attention for legal semiotics. Who has the power to define words and concepts? Who can successfully assume the power to speak on behalf of the legal community? Which methods are used to justify the power to define? This book discusses the questions mentioned above from three, related perspectives: Legal theory (Part I). This part discusses how more traditional approaches have dealt with the problem of legal interpretation and indeterminacy, questions the methods applied in traditional legal theory and offers new theoretical tools to understand the problem of legal interpretation. Judicial reasoning (Part II). The insights discussed in Part I are refined using legal semiotics, speech act theory and rhetorics and applied to the legal reasoning of courts and tribunals either in common law and civil law traditions. Application of law in politics and diplomatic practice (Part III). Traditionally, the study of legal reasoning has focussed on the application of law by courts and tribunals. However, legal reasoning also takes place outside the courtroom and takes up in the political and diplomatic arena. Who is included and excluded by particular conceptions of law? This chapter deals with the concept of the French national spirit for the construction of the national identity of France. Some of the most typical French official presidential photographs reveal a hidden discourse, a ‘Space-in-between’. These official photographs are part of French history and are also displayed in town halls even though there is no compulsory obligation to do so. However, some legal regulations have to be respected when shooting their portraits, but artists are also free to adapt their styles owing to each President’s will. Studying the visual and hidden discursive implications sheds light on semiotic, philosophical, and legal issues, as well as impacts on our legal culture, tradition and system. Taking into account space and time, the chapter proposes a reflection on the function, role, and limits of these visual and discursive representations, as well as impacts, recognitions and obligations deriving from them.

Any work on bodies requires a minimal knowledge of the general organization of cities, monuments, buildings and even their small devices. First of all we should consider the study of the shapes and structures of these bodies and their respective parts, as well as their relationships with each other. Then we will be in a better position for studying the functioning of the bodies, i.e. the way they play their roles and allow power to be maintained, regulated and/or forbidden.

Un jeu subtil associant les dimensions visuelles, culturelles ou sociales s’établit entre l’utilisateur de la règle et son destinataire. L’étude des différentes méthodes employées met en lumière cette dynamique du discours juridique. Cette nécessité de spécifier les rôles, de montrer les visages multiples a pour vocation de rendre sensible et conscient le locuteur au pluralisme organisé dans le discours juridique. C’est dans la multiplicité que le discours peut s’avérer fragile, susceptible de rupture dans la compréhension de sens.

This paper explores the role and impact of advertising in the French urban planning on citizens’ perception with a close examination of the implications and connections between citizens and outdoor advertising. Significant changes in quantity and form of outdoor advertising have been defined under French regulations. Our knowledge is now mass mediated in public spaces. More and more visible and gargantuan advertising signs surround and even invade our environment for strict commercial benefits. The ‘invasion’ of commercial signs can be compared to a visual pollution affecting our perception, autonomy in thinking and health depending on the part of the population being considered.
