Celui qu’honore cet ouvrage intitulé Le droit au service de l’humanité - Mélanges en l’honneur de Michel Hottelier n’est pas un « constitutionnaliste de salon » ou un « droit-de-l’hommiste ». Certes, il est l’un des auteurs du précis de droit constitutionnel suisse que les étudiants, chercheuses, magistrats, avocates et autres praticiens sont nombreux à utiliser, parfois quotidiennement. Mais il fut aussi membre de la constituante genevoise (2008-2012) et put ainsi vivre et contribuer à la naissance d’une constitution cantonale moderne. Ses conseils voire sa participation active à la défense judiciaire des droits humains ont aussi marqué plusieurs affaires, notamment lors de procédures devant la Cour européenne des droits de l'homme. La publication de ce livre, fruit de la collaboration et du grand engagement de nombreuses personnes, contient trente-sept contributions sur des thèmes chers à Michel Hottelier.

This book explores the challenges that multilateralism faces today and questions the idea of a ‘crisis’ of multilateral cooperation and international organizations. It accounts for the pressures on and power shifts in multilateralism in recent years - such as the war in Syria, the Covid-19 pandemic, challenges for NATO, the erosion of multilateral norms, the transition from Trump to Biden, the rise of China, the post-Brexit European Union, and the mobilization of countries from the South. The authors illustrate the resilience of multilateralism and lessons learned from the WTO, UN Women, International Organizations’ Secretariats and global environmental governance. Written in part by members of the Research Group on Multilateral Action (GRAM), this volume argues that ‘crisis’ should not be considered a pathology but the ‘matrix’ of multilateralism, which is more resilient than commonly thought. This book will be of interest to students and scholars of International Relations, global governance, and international organizations.

L’histoire des anciens présidents américains montre qu’en démocratie, rendre le pouvoir n’est guère moins important que le prendre ou l’exercer : c’est un acte indispensable à la continuité des institutions. Lorsque Donald Trump refuse de quitter la Maison-Blanche et tourne le dos à l’histoire de son pays, il fait peser une menace sur la démocratie américaine.

La tradition de transfert ordonné du pouvoir trouve ses origines dans la figure de George Washington qui, en choisissant de se retirer volontairement au terme de son second mandat, instaura un précèdent. Parmi ses successeurs, seul Franklin D. Roosevelt passa plus de huit ans à la tête de l’exécutif (1933-1945) ; en vigueur depuis 1951, le vingt-deuxième amendement interdit désormais d’effectuer plus de deux mandats.

Le retrait de Washington donna également naissance à la figure de l’ancien président, dont les contours se sont dessinés au fil du temps : après son discours d’adieu, il doit se dessaisir de ses archives, publier ses mémoires, laisser gouverner ses successeurs et répondre favorablement à leurs sollicitations quand il faut manifester l’unité de la nation.

Certains anciens présidents s’illustrèrent par une retraite longue et féconde : John Quincy Adams combattit l’esclavage à la Chambre des représentants; William Howard Taft présida la Cour suprême de 1921 à 1930 ; Jimmy Carter s’engagea dans l’action humanitaire après sa défaite de 1980. En refusant de rendre le pouvoir sans y être contraint, Donald Trump a bouleversé tous les précédents et rompu avec une tradition politique américaine vieille de plus de deux siècles.

Addressing the relationship between law and the visual, this book examines the importance of photography in Central, East, and Southeast European show trials.

The dispensation of justice during communist rule in Albania, East Germany, and Poland was reliant on legal propaganda, making the visual a fundamental part of the legitimacy of the law. Analysing photographs of trials, this book examines how this message was conveyed to audiences watching and participating in the spectacle of show trials. The book traces how this use of the visual was exported from the Soviet Union and imposed upon its satellite states in the immediate aftermath of the Second World War. It shows how the legal actors and political authorities embraced new photographic technologies to advance their legal propaganda and legal photography. Drawing on contemporary theoretical work in the area, the book then challenges straightforward accounts of the relationship between law and the visual, critically engaging entrenched legal historical narratives, in relation to three different protagonists, to offer the possibility of reclaiming and rewriting past accounts. As its analysis demonstrates, the power of images can also be subversive; and, as such, the cases it addresses contribute to the discourse on visual epistemology and open onto contemporary questions about law and its inherent performativity.

This original and insightful engagement with the relationship between law and the visual will appeal to legal and cultural theorists, as well as those with more specific interests in Stalinism, and in Central, East, and Southeast European history.
