    Qu'est-ce qu'enseigner le droit ?1 Est-ce enseigner le contenu de la règle de droit et, en l'occurrence, le traitement juridique du fait religieux en entreprise ? Est-ce replacer les réponses pratiques légales ou jurisprudentielles dans le contexte sociétal, économique, politique, philosophique… qui les entoure et qui préside à ces réponses ? Le problème juridique n'est-il qu'une question de technique ou est-il la traduction, la mise en mots du droit d'une lourde interrogation sociétale autour de la liberté de conscience, de pensée et de religion, des valeurs d'une société, de ses fondements ? La saynète fictive qui suit raconte un vœu pieux ou l'espoir laïc : que le travail du droit suscite à nouveau de tels échanges interrogatifs, perplexes parfois, naïfs, intranquilles2 entre des étudiants-citoyens égarés au milieu de certitudes aberrantes…

    Hakan Cakir, La diversification de la formation de la relation de travail en droits privé et public, soutenue en 2011 à Strasbourg en co-direction avec Pierre Eckly 

    L' étude du phénomène de la diversification de la formation de la relation de travail en droits public et privé, est au coeur de cette recherche qui se propose de revenir sur des questions récurrentes telles que l'instrurnentalisation du contrat; la distinction des concepts de carrière et d' emploi ; la distinction de la relation de travail négociée par stipulations ou celle exclusivement statutaire. Mais le sujet « la diversification de la formation de la relation de travail en droits public et privé» recèle un champ d'investigation bien plus large. Il s' agit d'examiner cette thématique sous une approche pluridisciplinaire en se livrant à une comparaison entre le droit de la fonction publique et le droit du travail. Une telle étude offre un éclairage nouveau tant sur la notion juridique d'emploi que sur celle de carrière ou encore sur celui de contrat par rapport aux statuts. Elle permet également de vérifier la pertinence de deux phénomènes: le premier consiste à reconnaître que le contrat opère un rapprochement des droits public et privé ; le second repose sur l' idée que la différenciation des statuts et du contrat maintien la subsistance d'une relation de travail d'une nature distincte en droits public et privé. Et le principal enseignement de cette recherche pourrait être le suivant: l'étude de la diversification de la formation de la relation de travail en droits public et privé démontre que de droit de la fonction publique et le droit du travail n'appartiennent pas à deux mondes opposés mais au même tout en préservant leurs particularités.
