In recent years, landmark rulings by domestic and international courts have affirmed that States have a duty to make best efforts to protect the climate system. But are corporations subject to comparable obligations? While the traditional view holds that private actors bear no direct duties under international law, can climate law nevertheless shape corporate behavior through contract, tort, property, corporate and consumer law? Climate science also poses challenges for lawyers and judges. Concepts such as carbon budgets, scenarios, contribution versus causation, or stranded assets are difficult to translate into legal reasoning. As scientific knowledge evolves, how can scientific consensus be reconciled with legal standards of evidence? More fundamentally, are courts equipped to address disputes between individual and collective interests, and between present realities and future climate imperatives? In the absence of sufficiently ambitious State action, how can courts assess corporate strategies without encroaching upon policy choices or corporate autonomy? Despite recent climate backlash, climate litigation continues to evolve through innovations in access to justice and new forms of accountability. Bringing together contributors from different legal traditions, this book examines legal and institutional challenges shaping climate litigation involving corporations in Europe.
